Artificial Intelligence Supplementary Terms

"AI Features" means the functionalities within the Service that utilise machine learning models, including but not limited to tools for generating marketing strategies, text-based content, image context descriptions, images, performing sentiment analysis, providing analytics insights, and suggesting prompts.

"Input" means any data, text, prompts, commands, selections, brand information, competitor details, uploaded assets, or other materials you provide or submit to be processed by the AI Features.

"Output" means any content, text, strategies, images, suggestions, analysis, descriptions, or other materials generated and returned by the AI Features based on the Input.

Your use of AI Features is subject to your compliance with the Main Terms (including subscription limits detailed in Section 3 and usage rules in Section 4) and these AI Terms. Exceeding permitted usage limits may result in restricted access or require upgrading your Subscription Plan, as per Section 3.2 of the Main Terms.

3.1 No Training on Your Specific Data: Consistent with our Privacy Policy (Section 6) and GDPR Statement (Section 6), Mundus AI does not use your specific Input, the Output generated uniquely for your Account, your confidential brand assets, or identifiable client data to train the core machine learning models offered generally to other users.

3.2 Anonymised Data for Improvement: We may use anonymised, aggregated data derived from general platform usage patterns and AI Feature interactions (e.g., feature engagement rates, anonymised prompt structures, performance metrics, without revealing your specific content or identity) solely for the purposes of monitoring, improving, developing, and ensuring the safety and effectiveness of the AI Features and the overall Service. This is conducted based on our Legitimate Interests as detailed in the Privacy Policy (Section 5).

3.3 Feedback: If you voluntarily provide feedback specifically about the AI Features, we may use that feedback to improve the Service.

4.1 Your Responsibility: You are solely responsible for your Input, including its legality, accuracy, and ensuring you have the necessary rights to use it. As explicitly stated in Section 5.5(b) of the Main Terms, you are also solely responsible for the mandatory review, verification, editing, fact-checking, and approval of all Output before any use or publication.

4.2 Compliance: Your Input and your use of the AI Features and Output must comply with all applicable laws, the Main Terms (especially Section 4.3 on Prohibited Activities), these AI Terms, and must not infringe any third-party rights.

4.3 Nature of Output: AI may generate similar or identical Output for different users providing similar Input. We make no guarantee of the uniqueness or originality of the Output (see Section 5.5(a) of the Main Terms).

5.1 Ownership Assignment: As stated in Section 5.2 of the Main Terms, subject to your full compliance with the Main Terms (including payment), Mundus AI assigns to you all its rights, title, and interest in the specific Output generated by the AI Features directly for your Account from your Input.

5.2 Platform Technology: As stated in Section 6.2 of the Main Terms, Mundus AI and its licensors retain all rights to the underlying AI technology, models, algorithms, and the Service itself. Your ownership applies only to the specific Output.

5.3 Limited Licence to Mundus AI: You grant Mundus AI a limited, non-exclusive, worldwide, royalty-free licence to host, process, store, and display your Input and Output solely as necessary to provide, maintain, secure, and improve the Service for you (e.g., displaying content in your dashboard, enabling scheduling/analytics). This licence aligns with the data usage purposes described in our Privacy Policy and does not permit general AI model training on your specific data (see Section 3.1 above).

5.4 User Responsibility & Indemnification: Your responsibilities regarding the use, review, and publication of Output, and your obligation to indemnify Mundus AI for claims arising from your use of Output (including infringement claims), are detailed in Sections 5.5 and 8 of the Main Terms.

In addition to the Prohibited Activities listed in Section 4.3 of the Main Terms, you specifically agree not to use the AI Features or any Output:

(a) To develop, train, fine-tune, or improve competing AI models or services.

(b) To generate content that violates the specific prohibitions in Section 5.5(c) of the Main Terms (illegal, harmful, infringing, etc.).

(c) To intentionally mislead recipients about the AI-generated nature of the content where context requires disclosure (e.g., in regulated fields or sensitive communications).

(d) In any manner that violates applicable laws or regulations specific to AI or automated content generation.

(e) To attempt to bypass safety filters or generate content violating the terms of underlying third-party AI providers (see Section 8 below).

THE AI FEATURES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE". CONSISTENT WITH SECTIONS 5.5(a) AND 7 OF THE MAIN TERMS, MUNDUS AI AND ITS LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE AI FEATURES AND OUTPUT. THIS INCLUDES, BUT IS NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, ORIGINALITY, NON-INFRINGEMENT, LEGALITY, OR EFFECTIVENESS. YOU BEAR SOLE RESPONSIBILITY FOR VALIDATING AND USING ANY OUTPUT. RELIANCE ON AI FEATURES OR OUTPUT IS ENTIRELY AT YOUR OWN RISK.

The AI Features may utilise services from third-party AI technology providers (as identified in our Privacy Policy / Sub-processor list). Your use of the AI Features implicitly requires compliance with the acceptable use policies of these providers. You agree not to use the AI Features in a manner violating such policies. Breaching these third-party policies in your use of Mundus AI may constitute a breach of our Main Terms, and you agree to indemnify Mundus AI for claims arising from such breaches, as per Section 8 of the Main Terms.

As stated in the Almanac example and relevant here: Downtime or performance issues of the AI Features specifically caused by failures or limitations of underlying third-party AI provider services may be excluded from general Service availability calculations or SLAs, if any are offered under your Plan.
